Please read these Terms of Service ("Terms") carefully before using the wefindpets.co.za platform ("Platform", "Service") operated by wefindpets ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you are at least 13 years of age. If you are under 18, you must have the consent of a parent or legal guardian. We reserve the right to suspend or terminate accounts belonging to users who misrepresent their age.
2. Account Registration
To use the Service, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, misleading, or in violation of these Terms.
3. Public Nature of Content
wefindpets is a community platform designed to help reunite lost pets with their owners. By its nature, certain information you provide is made publicly visible to other users of the platform.
By using the Service and adding content to your profile, you acknowledge and agree that the following information will be visible to other users:
Your first name and last name (if provided)
Your general location (e.g., city or province)
Your phone number (if provided and not hidden)
All pet profiles you register, including names, species, sex, descriptions, and photographs
Missing pet reports you submit, including photographs and location details
If you are not comfortable with this information being publicly visible, we respectfully advise that the wefindpets Service may not be suitable for you.
4. Acceptable Use
You agree not to:
Use the Service for any unlawful purpose or in violation of any applicable law or regulation
Submit false, misleading, or fraudulent pet reports or user information
Harass, abuse, or harm other users through the in-app messaging or any other feature
Use the Service to scrape, harvest, or collect personal data of other users without their consent
Attempt to gain unauthorised access to any part of the platform, its servers, or related systems
Upload content that is illegal, defamatory, obscene, or infringes the intellectual property rights of any third party
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
We reserve the right to suspend or permanently terminate accounts that violate these acceptable use terms, at our sole discretion.
5. Subscriptions and Billing
5.1 Subscription Plans
We offer free and paid subscription plans. The features included in each plan, and the pricing, are described on our pricing page. We reserve the right to modify, add, or remove features from any plan and to change pricing at any time. Where pricing changes affect existing subscribers, we will provide reasonable advance notice by email or platform notification.
5.2 Billing and Payment
Paid subscriptions are billed on a recurring basis (monthly). Payment is processed by our third-party payment gateway provider. By subscribing, you authorise us (via our payment provider) to charge your designated payment method on each billing date until you cancel. You are responsible for ensuring your payment details remain current and accurate.
5.3 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing cycle. You will retain access to all paid features until the end of the period for which you have already paid. No partial refunds are issued for unused time within a billing period, except as required by applicable law.
5.4 Refunds
All subscription payments are non-refundable except where required by law. If you believe you have been charged in error, please contact us promptly and we will investigate.
5.5 Failed Payments
If a payment fails, your account may be downgraded to the free tier and access to paid features may be suspended until the outstanding payment is resolved.
6. User-Generated Content
You retain ownership of the content you submit to the platform, including pet photographs and profile information. By submitting content, you grant wefindpets a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content solely for the purpose of operating and providing the Service, including displaying content publicly as described in Section 3.
You represent and warrant that you own or have the necessary rights to all content you submit, and that your content does not violate any third-party rights or applicable law.
7. AI-Assisted Features
The Service includes AI-powered pet re-identification features that analyse pet photographs to assist in finding potential matches. These features are provided as a tool to assist users and do not constitute a guarantee of accuracy or of a confirmed match. You should exercise your own judgement before acting on any AI match result. We are not liable for false positives, missed matches, or any actions taken based on AI-generated results.
8. Intellectual Property
The wefindpets platform, including its design, software, trademarks, and content produced by us, is owned by wefindpets and protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the platform without our prior written consent.
9. Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or that any pet will be found or returned. The platform is a tool to assist in pet recovery; outcomes are not guaranteed.
To the maximum extent permitted by applicable law, wefindpets shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including any loss of data, revenue, or goodwill, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or relating to these Terms or the Service shall not exceed the total amount paid by you to wefindpets in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless wefindpets and its officers, employees, and agents from and against any claims, damages, losses, and expenses (including legal fees) arising out of or relating to your use of the Service, your content, or your violation of these Terms.
11. Termination
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination shall do so, including Sections 6, 8, 9, 10, and 13.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a prominent notice on the platform. Your continued use of the Service after the effective date of a revised set of Terms constitutes your acceptance of the updated terms. If you do not accept the revised Terms, you must stop using the Service.
13. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
